PlanPro360 Terms of Use
Last Updated: September 22, 2026
These Terms of Use ("Terms") govern your access to and use of planpro360.com (the "Site") and the property feasibility, research, assessment, comparison, cost analysis, and related services offered by PlanPro360 ("PlanPro360," "we," "us," or "our").
Please read these Terms carefully. By accessing or using the Site, purchasing a service, or submitting information to PlanPro360 in connection with a service, you agree to these Terms. If you do not agree to these Terms, do not use the Site or purchase our services.
1. Our Services
PlanPro360 provides preliminary property feasibility information, research, assessments, comparisons, development-cost analysis, and related planning resources intended to help property owners, prospective property purchasers, and others better understand potential development considerations before committing substantial time or money to a project.
Our services may include products such as BuildSmart, Site Select, PriceGuard Snapshot, Full PriceGuard, and other property-planning or feasibility services that PlanPro360 may offer from time to time.
The scope, features, pricing, and availability of our services may change. The description presented at the time of purchase forms part of the scope of the service purchased.
2. Preliminary and Informational Nature of Assessments
PlanPro360 assessments and other materials are preliminary and informational only.
They are intended to assist with early-stage property and project evaluation. They are not, and should not be treated as:
- a building permit or other governmental approval;
- an official zoning determination or interpretation;
- a land survey;
- an appraisal;
- an environmental assessment;
- an engineering, architectural, geotechnical, legal, tax, financial, or other professional opinion;
- a title report;
- a guarantee that a particular home, structure, improvement, or project can be constructed on a property; or
- a guarantee that any permit, entitlement, variance, utility connection, financing, or other approval will be obtained.
A PlanPro360 assessment does not replace the due diligence that may be appropriate before purchasing property, ordering a home, beginning design or construction, entering into contracts, or making other significant financial commitments.
3. Information Sources, Third-Party Data, and Assumptions
PlanPro360 may prepare assessments using information obtained from customers and from third-party or public sources, including governmental records, zoning and planning information, mapping resources, property databases, geographic information systems, public records, technology platforms, and other research resources.
We may also use third-party software, data services, research tools, or technology providers to assist in preparing an assessment.
PlanPro360 makes reasonable efforts to provide useful information based on the information reasonably available to us at the time of the assessment. However, third-party and public information may be incomplete, inaccurate, outdated, inconsistent, unavailable, or subject to interpretation.
Laws, ordinances, zoning requirements, development standards, agency practices, maps, property conditions, utility availability, fees, and other circumstances may also change after an assessment is prepared.
An assessment may necessarily rely on assumptions based on the information available at the time. Those assumptions may later prove incorrect.
Accordingly, PlanPro360 does not warrant that third-party information, public records, maps, calculations, estimates, assumptions, or other information used in an assessment is complete, current, or error-free.
4. Customer Information and Responsibilities
You are responsible for providing information that is accurate and complete to the best of your knowledge.
The usefulness and accuracy of an assessment may be affected by inaccurate, incomplete, outdated, or omitted information concerning the property or proposed project.
You are responsible for reviewing your assessment and obtaining any additional investigation, verification, professional advice, governmental confirmation, inspection, testing, survey, engineering, design work, or other due diligence appropriate to your circumstances before relying on the assessment to make a significant property, project, contractual, or financial decision.
Where appropriate, property and project information should be independently confirmed with the relevant governmental agencies and qualified professionals.
5. No Guarantee of Buildability or Approval
PlanPro360 does not guarantee that a property is buildable or suitable for a particular project.
An indication that a proposed project may appear feasible based on preliminary research does not mean that the project has been approved or that later investigation will not identify additional restrictions, costs, requirements, or obstacles.
Final feasibility may depend on matters outside the scope of a PlanPro360 assessment, including site-specific conditions, surveys, title matters, easements, utilities, environmental conditions, soils, drainage, access, fire requirements, engineering, architectural design, agency interpretation, discretionary approvals, permit review, and other factors.
Government agencies and other authorities retain responsibility for their own determinations, interpretations, approvals, and requirements.
6. BuildSmart
BuildSmart is a preliminary assessment of a customer-specified property for a proposed new-home or property-development concept.
The service is designed to help identify potentially relevant property information, development standards, constraints, and other considerations based on the information available at the time of the assessment.
Unless expressly stated otherwise in the service description, BuildSmart does not include final design, engineering, surveying, permit preparation, permit approval, legal advice, contractor services, or verification of all physical conditions affecting a property.
7. Site Select
Site Select allows a customer to submit up to five customer-selected properties for preliminary evaluation and comparison under one qualifying purchase.
PlanPro360 does not act as a real estate broker or property-search service through Site Select and does not select properties for the customer.
Site Select is intended to provide information that may assist a customer in comparing potential properties. It does not identify, certify, warrant, or guarantee a definitive "best" property or assure that any property is suitable for the customer's proposed project.
Different properties may involve different advantages, limitations, uncertainties, costs, and matters requiring further investigation. The ultimate decision whether to purchase or pursue a particular property remains solely with the customer.
Site Select properties may be submitted all at once or over time. Unused property submissions do not expire.
8. PriceGuard
PriceGuard is a development-cost analysis service. PlanPro360 offers two PriceGuard products: PriceGuard Snapshot and Full PriceGuard. Both products cover development costs only and do not include land purchase price, home purchase price, factory options, stick-built home construction contract price, financing, or an overall all-in project cost. When crane or special access is applicable, a separate quote is required and must be obtained by the customer.
PriceGuard is available for eligible projects in select service areas. Eligibility is determined by PlanPro360 following evaluation of the applicable property through BuildSmart or Site Select.
PriceGuard Snapshot provides a broad development-cost range using standardized estimating assumptions and information PlanPro360 already gathered through the customer's BuildSmart or Site Select assessment. The customer receives the overall development-cost range, major assumptions, important cost risks and unknowns, and important exclusions. The customer does not receive the underlying individual line-item cost breakdown.
Full PriceGuard is a detailed property-specific development-cost projection. Full PriceGuard uses the property and project information already established through BuildSmart or Site Select, then adds property-specific cost research, measurements and quantities, individual development-cost line items and ranges, fee and utility research, and contractor review and verification before delivery. Full PriceGuard does not perform a second property feasibility or site analysis.
Each PriceGuard product applies to one specific property and project. If a customer purchases a PriceGuard Snapshot and later upgrades the same property and project to Full PriceGuard, the amount paid for the Snapshot will be credited toward the Full PriceGuard price. A Snapshot purchased for one property does not create a credit toward Full PriceGuard for a different property.
PriceGuard cost ranges and estimates are informational planning estimates only. Actual costs may vary substantially based on property conditions, location, design, market conditions, contractor pricing, governmental requirements, utility requirements, fees, inflation, timing, and other circumstances. A PriceGuard estimate is not a contractor bid, binding quote, appraisal, or guarantee of actual project cost.
9. Turnaround Times
PlanPro360 may provide estimated or target turnaround times for its services.
Current target turnaround times may include within 48 business hours for BuildSmart and, for Site Select, individual property evaluations typically completed within 48 business hours, with multiple properties submitted together potentially requiring additional time, unless otherwise stated at the time of purchase.
Turnaround times are estimates rather than guarantees. Completion may be affected by the availability of governmental, third-party, customer, or property information; technical issues; unusual property circumstances; holidays; volume; or other matters outside PlanPro360's reasonable control.
If additional information is reasonably necessary to complete an assessment, turnaround time may be affected until that information is received.
10. Orders, Prices, and Payments
Prices and service descriptions are those displayed at the time of purchase, subject to applicable promotional offers or discounts.
Payments are processed through Stripe or another payment processor PlanPro360 may use.
You agree to provide accurate payment and order information and authorize the applicable charge for the service selected.
Promotional offers and discount codes may be subject to eligibility requirements and may be changed or discontinued as permitted by applicable law.
If an order cannot reasonably be completed because required information has not been provided, PlanPro360 may contact the customer for additional information.
Any refund, cancellation, or order-adjustment rights required by applicable law remain unaffected by these Terms. Any additional refund or cancellation policy expressly presented at the time of purchase will also apply.
11. Referrals and Independent Third Parties
PlanPro360 may receive customers through referrals from independent home dealers, real estate professionals, businesses, or other third parties.
A referring company is separate from PlanPro360 unless expressly stated otherwise.
A referral, promotional offer, or discount does not make the referring company responsible for preparing, reviewing, verifying, or guaranteeing a PlanPro360 assessment, and PlanPro360 does not make the referring company responsible for the information, conclusions, or limitations contained in an assessment.
Where a particular referral offer expressly discloses that PlanPro360 may provide the referring company with a copy of a completed assessment or other specified information, such information may be shared as described in the applicable disclosure and our Privacy Notice.
PlanPro360 does not automatically provide every customer's assessment or information to an unrelated dealer or referral source.
12. Third-Party Professionals and Services
PlanPro360 may identify or refer customers to governmental agencies, engineers, surveyors, contractors, architects, real estate professionals, consultants, utilities, or other independent third parties when additional information or services may be appropriate.
Unless expressly agreed otherwise in writing, those persons and organizations are independent of PlanPro360.
PlanPro360 does not hire, supervise, control, warrant, or guarantee the work, pricing, availability, advice, performance, licensing, conduct, or results of independent third parties selected or engaged by a customer.
Customers are responsible for evaluating and contracting directly with any professionals or service providers they choose to use.
13. No Professional Relationship
Use of PlanPro360's Site or services does not create an attorney-client, engineer-client, architect-client, fiduciary, brokerage, agency, contractor, or other licensed professional relationship between you and PlanPro360.
PlanPro360 does not provide legal, engineering, architectural, surveying, appraisal, financial, tax, or other licensed professional services unless expressly stated in a separate written agreement executed by an appropriately qualified provider.
14. Estimates and Cost Information
If PlanPro360 provides preliminary cost ranges, budget information, fee information, or other estimates, those figures are informational planning estimates only unless expressly stated otherwise.
Actual costs may vary substantially based on property conditions, location, design, market conditions, contractor pricing, governmental requirements, utility requirements, fees, inflation, timing, and other circumstances.
An estimate is not a contractor bid, binding quote, appraisal, or guarantee of actual project cost.
15. Intellectual Property
The Site and PlanPro360-created materials, including the PlanPro360 name, branding, website content, assessment formats, explanatory materials, graphics, processes, and original written content, are owned by or licensed to PlanPro360 and are protected by applicable intellectual-property laws.
Subject to these Terms, a customer may use a purchased assessment for the customer's personal or internal business evaluation of the applicable property or project and may provide it to professionals, governmental agencies, lenders, sellers, or others reasonably involved in evaluating that property or project.
You may not reproduce, sell, publish, commercially distribute, systematically extract, or create a competing commercial product or service from PlanPro360 materials without our written permission, except as permitted by applicable law.
Third-party information contained in an assessment remains subject to any rights or restrictions applicable to that information.
16. Acceptable Use
You agree not to misuse the Site or PlanPro360 services.
You may not knowingly:
- provide fraudulent information or use another person's identity without authorization;
- attempt to gain unauthorized access to our systems, data, or another customer's order;
- interfere with the operation or security of the Site;
- introduce malicious code or use automated means to disrupt or improperly extract information from the Site;
- use PlanPro360 services for unlawful purposes; or
- infringe PlanPro360's or another party's intellectual-property or other legal rights.
We may restrict access to the Site or decline service when reasonably necessary to protect PlanPro360, our customers, our systems, or others from fraud, misuse, security threats, or unlawful activity.
17. Disclaimer of Warranties
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE, ASSESSMENTS, REPORTS, INFORMATION, AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.
PLANPRO360 DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY OTHER WARRANTIES THAT MAY LEGALLY BE DISCLAIMED.
PLANPRO360 DOES NOT WARRANT OR GUARANTEE THAT AN ASSESSMENT WILL IDENTIFY EVERY CONDITION, RESTRICTION, COST, REQUIREMENT, OR ISSUE THAT MAY AFFECT A PROPERTY OR PROJECT, OR THAT INFORMATION OBTAINED FROM THIRD PARTIES OR PUBLIC SOURCES WILL BE COMPLETE, CURRENT, OR ERROR-FREE.
Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.
18. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PLANPRO360 WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST OPPORTUNITIES, LOSS OF USE, OR SIMILAR LOSSES ARISING FROM OR RELATED TO THE SITE, AN ASSESSMENT, OR THE SERVICES.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PLANPRO360'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR PURCHASED SERVICE WILL NOT EXCEED THE AMOUNT ACTUALLY PAID TO PLANPRO360 FOR THAT SERVICE.
These limitations are intended to allocate risk in light of the preliminary and informational nature and price of PlanPro360's services.
Some jurisdictions do not permit certain limitations or exclusions of liability. Accordingly, the limitations above apply only to the extent permitted by applicable law.
Nothing in these Terms limits liability that cannot legally be limited or excluded.
19. Privacy
Our collection, use, and disclosure of personal information are described in the PlanPro360 Privacy Notice.
The Privacy Notice is incorporated by reference where permitted by applicable law.
20. Changes to Services and These Terms
PlanPro360 may modify its Site, services, service descriptions, or these Terms from time to time as the business evolves or as legal, operational, or technological requirements change.
Changes to these Terms will be reflected by an updated "Last Updated" date.
Where required by applicable law, we will provide additional notice of material changes.
The version of the Terms applicable to a transaction generally will be the version presented or in effect when that transaction occurred, except where applicable law requires otherwise or the parties subsequently agree to different terms.
21. Governing Law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles, except to the extent applicable law requires otherwise.
Nothing in these Terms deprives a consumer of protections that cannot lawfully be waived under applicable law.
22. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or, where appropriate, severed, and the remaining provisions will remain in effect.
23. Entire Agreement
These Terms, together with the applicable service description, Privacy Notice, disclosures presented during ordering, and any other terms expressly incorporated into a transaction, constitute the agreement between you and PlanPro360 concerning the applicable Site and service, except to the extent a separate written agreement expressly provides otherwise.
